General terms of subscription to the assistant

1. Purpose

These terms govern the subscription to the cosmetic advice assistant of the K-Beauty Paris website (“the Service”), offered by the publisher identified in the legal notice, established in Belgium. The Service is automated advice software; it does not concern any Atomy product. Products are purchased on atomy.com, at the same price for everyone, with or without a subscription. The contract is concluded in French; this translation is provided for information only.

2. Plans and prices

• Discovery, free: a one-time trial of 9 questions, after receiving an access code by e-mail. This trial cannot be renewed: once the 9 questions have been asked, continued use requires a subscription. The conversation is kept in the browser.
• Advice: €9 per month or €90 per year. Unlimited questions, conversations saved on the account.
• Coaching: €19 per month or €190 per year. Everything in Advice, a remembered beauty profile, more in-depth answers, priority access codes for your loved ones.

Prices inclusive of all taxes, in euros, including Belgian VAT at the applicable rate. The publisher may change the prices; a change applies to a current subscription only at its next renewal, after notification by e-mail at least 30 days in advance, with the option to cancel free of charge.

3. Subscription and payment

Subscribing requires an account (verified e-mail address) and card payment via Stripe, our provider; we do not store your card number. The subscription starts as soon as the payment is accepted and renews automatically at each due date, monthly or yearly, until cancellation. Invoices are available from “My account”.

If a payment fails, access is maintained for a few days to allow a new attempt, then suspended until the situation is resolved.

4. Duration, cancellation, change of plan

No minimum commitment. You may cancel at any time from “My account”: access remains open until the end of the period already paid and no further payment is taken. Switching to another plan is possible at any time, prorated by Stripe. The publisher may terminate the Service with 30 days’ notice; paid periods not yet used are then refunded.

5. Right of withdrawal

In accordance with Articles VI.47 et seq. of the Belgian Code of Economic Law, you have 14 days from subscribing to withdraw, without giving any reason, by writing to contact@k-beauty.paris or by using the model withdrawal form (Annex 2 of Book VI of the Code of Economic Law). By subscribing, you expressly request that the Service begin before the end of this period; in the event of withdrawal, you pay only the part of the price proportional to the period already provided (Article VI.51). The refund is made within 14 days.

6. Nature and limits of the Service

• The Service provides cosmetic advice generated automatically from Atomy’s official product sheets. It provides neither medical advice, nor a diagnosis, nor a health claim. Consult a healthcare professional for any medical condition, pregnancy, breastfeeding or ongoing treatment.
• Answers may contain errors or omissions; they are no substitute for reading the product label or the information on atomy.com, which prevails.
• The Service may be unavailable for maintenance or in the event of a provider outage. A prolonged unavailability of more than 72 consecutive hours entitles you to an extension of the paid period.
• Personal use only. The following are prohibited: sharing the account, automated extraction of answers, using the Service for another site or service.

7. Your data

The processing of your data is described in the privacy policy. You may delete your conversations and your beauty profile at any time.

8. Independence from Atomy

The Service is offered by an independent member of Atomy Europe and is neither operated nor endorsed by Atomy. The subscription confers no advantage on the products, whose price is identical for everyone.

9. Complaints, mediation, applicable law

For any complaint: contact@k-beauty.paris. Failing an amicable solution, you may refer the matter free of charge to the Consumer Mediation Service, Boulevard du Roi Albert II 8 bte 1, 1000 Brussels, mediationconsommateur.be, or use the European online dispute resolution platform (ec.europa.eu/consumers/odr). Belgian law applies; in the event of a dispute, the Belgian courts have jurisdiction, without prejudice to the mandatory consumer-protection rules of your country of residence.
